Privacy Policy Overview

This Privacy Policy explains how we collect, hold, use, disclose, store, secure and manage personal information in connection with our website, platform, portals, software, electronic signing tools, AI-assisted features, workflow tools, automations, integrations and related services.

This Privacy Policy applies to personal information handled by Delegate in Australia. Delegate is not currently targeting New Zealand, the European Union or other international markets.

By accessing or using our website, Platform or Services, creating an account, signing a service agreement, inviting users, uploading information, using a portal, using electronic signing, using AI-assisted features or otherwise dealing with us, you acknowledge that you have read and understood this Privacy Policy.

If you do not agree with this Privacy Policy, you should not access or use the Platform or Services.

1. Scope of this Privacy Policy

This Privacy Policy applies to personal information collected, held, used or disclosed through or in connection with Delegate's services, including:

  1. the Delegate My Work website;
  2. the Delegate My Work software platform;
  3. property management workflows;
  4. sales workflows;
  5. client onboarding workflows;
  6. owner portals;
  7. tenant portals;
  8. supplier and trade portals;
  9. referral partner portals;
  10. agency staff portals;
  11. electronic signing features;
  12. AI-assisted features;
  13. forms, checklists, automations and templates;
  14. integrations with third-party systems;
  15. support, training and onboarding services; and
  16. billing, payment and account administration.

This Privacy Policy should be read together with our Terms and Conditions and any service agreement, proposal, order form or subscription agreement between you and Delegate.

2. What is Personal Information?

Personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether it is recorded in a material form or not.

Examples include a person's name, email address, phone number, address, date of birth, account details, identity information, property information connected to an individual, communication records and other information that can reasonably identify a person.

The types of personal information we collect depend on how you interact with Delegate and how our customers use the Platform.

Delegate does not require customers to upload sensitive information unless it is reasonably necessary for the customer's lawful use of the Platform.

If you provide sensitive information to Delegate or upload it to the Platform, you warrant that:

  1. you are legally permitted to do so;
  2. you have obtained any required consent;
  3. the information is reasonably necessary for the relevant purpose; and
  4. the information is handled in accordance with applicable privacy laws and your own privacy obligations.

We may use or disclose sensitive information only where permitted by law, with consent, or where reasonably necessary to provide the Services.

6. Customer Responsibility for Third-Party Personal Information

Our customers may upload, sync, import or enter personal information about owners, tenants, residents, applicants, suppliers, trades, referral partners, employees, contractors and other individuals.

Where you provide personal information about another person, you are responsible for ensuring that:

  1. you have authority to provide that information to Delegate;
  2. the person has been given any required privacy notice;
  3. any required consent has been obtained;
  4. the information is accurate and lawful;
  5. the information is relevant to the purpose for which it is provided; and
  6. your use of the Platform complies with your own privacy obligations.

Delegate does not independently verify whether a customer has authority to provide personal information to the Platform.

7. Why We Collect, Hold, Use and Disclose Personal Information

We collect, hold, use and disclose personal information for purposes connected with operating Delegate and providing the Platform, including to:

  1. provide the Platform and Services;
  2. create and manage accounts;
  3. verify users and access rights;
  4. configure workflows, portals, automations and dashboards;
  5. provide owner, tenant, supplier, trade and referral partner portal access;
  6. support property management workflows;
  7. support sales workflows;
  8. support client onboarding;
  9. support electronic signing;
  10. support AI-assisted features;
  11. import, sync, process and display data;
  12. send service notifications, reminders and operational communications;
  13. provide training, onboarding and support;
  14. respond to enquiries, complaints and feedback;
  15. manage billing, subscriptions and payments;
  16. process payments through Stripe or other payment processors;
  17. monitor Platform usage and performance;
  18. improve, maintain and develop the Platform;
  19. troubleshoot errors and technical issues;
  20. protect security and prevent misuse;

8. Platform Communications

The Platform may generate, store or send emails, SMS messages, reminders, alerts, owner updates, tenant updates, supplier messages, referral partner messages, internal comments, notifications and other communications.

Messages sent through or generated by the Platform are treated as part of the Platform for the purposes of this Privacy Policy.

You are responsible for ensuring that communications sent by you or on your behalf through the Platform are lawful, accurate and sent to the correct recipients.

9. AI-Assisted Features

Delegate may include AI-assisted features using providers such as OpenAI, Google and other artificial intelligence providers.

AI-assisted features may be used to:

  1. draft emails, messages, summaries or documents;
  2. summarise records, notes or communications;
  3. classify workflow information;
  4. extract information from uploaded content;
  5. suggest next steps;
  6. assist with checklists, tasks and workflows;
  7. improve search, reporting and usability; and
  8. support other Platform functions.

When AI-assisted features are used, information submitted to those features may be processed by Delegate and relevant AI providers to provide the requested functionality.

Unless expressly agreed in writing, Delegate will not use identifiable Customer Data to train a public AI model.

AI outputs may be inaccurate, incomplete or unsuitable. Customers and users are responsible for reviewing AI outputs before using, sending, relying on or publishing them.

You should not submit sensitive information into AI-assisted features unless it is necessary, lawful and authorised.

10. Electronic Signing

Delegate may include electronic signing features.

When electronic signing is used, we may collect and process information such as:

  1. signer name;
  2. signer email address;
  3. signing status;
  4. signature records;
  5. timestamps;
  6. IP address or device information;
  7. document access history;
  8. completion history; and
  9. signed documents.

This information is collected and used to facilitate electronic signing, maintain records, verify signing activity, support audit trails and provide the Services.

Customers are responsible for ensuring that documents are suitable for electronic signing and that signers have authority to sign.

11. Payment Information

Delegate uses Stripe for payment processing.

We may collect and store limited billing information, such as billing contact details, invoice details, subscription details, payment status and transaction references.

Credit card and payment details may be collected and processed directly by Stripe or another payment processor. Delegate does not intend to store full credit card details on its own servers.

Payment processors may collect, use and store personal information in accordance with their own terms and privacy policies.

12. Disclosure to Third Parties

We may disclose personal information to third parties where reasonably necessary to provide, operate, secure and improve the Platform.

Delegate's servers are currently located in Sydney, Australia.

However, some Third Party Providers may process, store or access personal information from outside Australia. This may include providers of AI, cloud infrastructure, email, SMS, analytics, support, security, payments, document processing and other technology services.

Where personal information is disclosed or made accessible overseas, we will take reasonable steps to use reputable providers and manage privacy and security risks.

By using the Platform, you acknowledge that personal information may be disclosed to, processed by or accessed from locations outside Australia where reasonably necessary to provide the Services.

14. Security of Personal Information

We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure.

These steps may include:

  1. hosting data on secure servers located in Sydney, Australia;

  3. user permissions;

However, no software, server, transmission, integration, AI provider, payment processor or internet-based service can be guaranteed to be completely secure.

You are responsible for maintaining the security of your own systems, devices, email accounts, passwords, user permissions and staff access.

You must notify us immediately if you become aware of any actual or suspected unauthorised access, data breach, compromised login, incorrect disclosure or misuse of personal information involving the Platform.

15. Data Retention and Deletion

We retain personal information for as long as reasonably required to provide the Services, operate our business, comply with legal obligations, resolve disputes, maintain records and enforce our agreements.

After cancellation, expiry or termination of a customer's service agreement, Delegate will retain Customer Data for 30 days, unless otherwise required by law, backup processes, security requirements, dispute requirements or written agreement.

During that 30-day period, the customer may request a reasonable export of Customer Data.

After the 30-day retention period, we may delete, archive or de-identify Customer Data.

We may retain limited business records, invoices, payment records, audit logs, support history, security records and legal records for longer where required for legitimate business, legal, accounting, tax, security or compliance purposes.

16. Accessing and Correcting Personal Information

You may request access to personal information we hold about you.

You may also request correction of personal information if you believe it is inaccurate, out of date, incomplete, irrelevant or misleading.
